Bad new york1/18/2024 Under this law, an individual who writes a check without sufficient funds in their account or who writes a check on a closed account can be charged with the crime of issuing a bad check. New York Penal Law ยง 190.05, Issuing a Bad Check, makes it a crime to knowingly issue or pass a check for the payment of money when the issuer knows that there are insufficient funds in the account to cover the check, or that the check will be dishonored upon presentation.
